U.S. Car Import Age Rules: 25 Years Versus 21 Years

The clear answer

The U.S. 25-year and 21-year vehicle import provisions concern different agencies. NHTSA's age provision addresses federal vehicle safety standards; EPA's provision addresses emissions and includes configuration conditions. Meeting one does not establish that every import and registration requirement has been satisfied.

Scope: Age-based federal import planning; vehicle identity, configuration, entry records, and state requirements still matter.

NHTSA: verify the manufacture date

NHTSA explains that the 25-year period runs from the vehicle's manufacture date. Do not treat the advertised model year or a seller's description as sufficient proof that the vehicle has reached the threshold on the intended import date.

Obtain reliable manufacture-date evidence and have the import professional confirm the applicable HS-7 declaration basis. Plan shipping and arrival around verified eligibility rather than a rough assumption about the age of the model range.

EPA: age and engine configuration both matter

EPA's procedures describe the 21-year age calculation using the calendar year of manufacture and calendar year of importation. The agency's current guidance also emphasizes engine equivalence: the relevant engine must be the same model and configuration as the original. EPA encourages prospective importers to ask its Imports Hotline about that requirement before importing.

A replacement engine, conversion, or uncertain configuration deserves review. Do not rely only on the chassis age, or assume that every engine swap is acceptable because the car is old. Ask what evidence and declaration are appropriate to the actual vehicle.

Restored and reconstructed vehicles need care

Gather the vehicle's identity records, manufacture evidence, restoration invoices, and descriptions of major component changes. NHTSA's published interpretations distinguish restoration questions from situations that may amount to manufacturing or assembling another vehicle.

An old VIN plate or aged component does not by itself settle the import age of a substantially reconstructed car. Present the facts to the relevant agency or qualified import specialist before purchase or shipment if the history is unclear.

Make a two-agency evidence file

– Manufacture-date and vehicle-identity evidence. – Engine model, configuration, and known replacement history. – Photos of certification and identification labels where present. – Ownership and purchase records that describe the same vehicle. – Written eligibility advice and the planned declaration basis for each agency.

Keep federal import eligibility separate from destination-state registration. A vehicle can require additional state documentation or have road-use restrictions despite satisfying a federal age provision.

Planning example: a buyer finds a vehicle that meets EPA's age calculation but is still short of NHTSA's 25-year threshold. The EPA provision alone does not create a permanent safety-standard import pathway.

Common questions

Is a 25-year-old vehicle automatically paperwork-free?

No. Entry declarations, ownership evidence, and other applicable requirements remain.

Does an older model year prove the manufacture date?

Not by itself. Obtain reliable evidence for the actual vehicle.

Should I book transport while engine-history questions are unresolved?

Resolve eligibility first so the arrival does not create avoidable storage or re-export problems.

Coordinate the next step

Confirm export, import, or coverage questions with the responsible carrier, agency, insurer, or qualified trade professional. For a U.S. inland transport inquiry, request a callback with the route and vehicle details. This inquiry does not arrange customs clearance, establish eligibility, book transportation, or take payment.
